Does My Employer Have to Carry This Insurance?

Every employer in Maryland is required to carry workers’ compensation insurance. There's no requirement that they have a certain amount of employees. If you have one employee, you're required to carry workers’ compensation insurance.

So if you are hurt at work, there should be workers’ compensation coverage for you. Even if their employer does not have it, there is a state fund that we can go after as well, to fill in the gap where your employer didn't have it.

What If My Employer Doesn’t Have Workers’ Comp?

In the situation where an employer has failed to get workers' compensation insurance coverage for their employees, there is a state fund with Maryland called the Uninsured Employers Fund.

Now, what the Uninsured Employers Fund does is act as an insurance company to provide workers' compensation insurance coverage where people don't have it through their employer.

And they provide all the same benefits that a regular workers' compensation insurance company would. However, handling these cases is a little bit different than handling a normal workers' compensation case.
