Onewheel E-Skateboards Recalled Following Multiple Deaths
The recent recall of all models of Onewheel electric skateboards by Future Motion has brought to light a pressing issue for riders and enthusiasts of these popular self-balancing devices. With reports of four tragic deaths and numerous serious injuries linked to the e-skateboards across the country, consumers have raised concerns about the safety of similar products.
As injuries and other damages stemming from e-skateboards, hoverboards, and e-bikes increase in number, it’s imperative for affected individuals to understand their legal options and the potential path towards compensation. Our Maryland product liability attorney discusses this important recall in today’s blog.
The recall and preceding events
Between 2019 and 2021, four deaths were reported involving Future Motion’s Onewheel electric skateboards. All of the reported fatalities resulted from head trauma, and in at least three of the cases, the rider hadn’t been wearing a helmet. The U.S. Consumer Product Safety Commission (CPSC) said that the company received “dozens of reports” of severe, non-fatal injuries including fractures, concussion, paralysis, traumatic brain injuries, and ligament damage.
In response to these incidents, the CPSC issued a recall notice in November 2022. Initially, Future Motion resisted the CPSC’s call for a recall, but the company later reversed its stance and began cooperating with the regulatory body. In September 2023, Future Motion finally issued a voluntary recall of 300,000 e-skateboards.
The Onewheel hazard: causes and risks
The Onewheel electric skateboard is distinguished by its unique design featuring a single, fat-tire wheel that autonomously balances as electric power propels the rider forward. The hazard arises from the board’s capacity to cease its balancing function if pushed beyond its operational limits. This malfunction, if triggered, presents a severe crash hazard, which could result in grave injuries or even death. Alongside the product recall, the U.S. Consumer Product Safety Commission (CPSC) has issued a stern advisory, urging current owners of these skateboards to immediately cease their usage.
Parallels across new tech innovations
As technology advances, so do the potential risks associated with these cutting-edge innovations. Electric skateboards are now in the spotlight due to recent incidents, but they are not the sole culprits in this wave of new tech hazards. E-scooters have witnessed a surge in injuries among children, while e-bikes have faced scrutiny stemming from explosive batteries, posing significant threats to riders. Hoverboards, which have been made immensely popular through social media, have been known to overheat and, in some instances, even catch fire.
Beyond these alarming incidents, a common thread runs through these products even when they behave normally: their inherently dangerous designs. E-boards, hoverboards, and the like tend to be difficult to balance and frequently subject their riders to abrupt changes in speed, presenting fall risks.
Firmware updates and refund options
In response to the Onewheel recall, Future Motion has taken other steps to address the safety concerns surrounding their electric skateboards. One measure is the introduction of a firmware update featuring a “haptic buzz” safety alert system so “’riders can hear and feel’ when they may be in danger of crashing” in real time through their phones. Eligible Onewheel models, including GT, Pint X, Pint, and XR, will receive this update in the coming weeks.
However, not all Onewheel models are eligible for this firmware update. Original Onewheel and Onewheel+ boards fall outside the scope of this safety enhancement. For owners of these models, Future Motion is offering a prorated refund option in the form of $100 in-store credit. This allows affected individuals to dispose of their products safely while receiving compensation towards future purchases. These devices can cost between $1,000 and $2,200, according to Stoked Ride Shop.
Product liability and personal injury in Maryland
Victims of Onewheel incidents may seek legal recourse to pursue rightful compensation for injuries sustained. While product safety warnings and recalls offer some protection to the companies responsible for injuries to their customers, they do not absolve them entirely of potential legal action. Future Motion owes a duty of care to its consumers, and when individuals are harmed by their products, they must be held accountable. By working with a personal injury attorney, victims can pursue justice and compensation for their injuries and other losses.
